The agency's penalty
€59
When the penalty in your mandate is void, when a judge only cuts it down, the few cases in which it holds — and the letter that answers them, ready to send.
You want out of the mandate, or the agency is asking you for money because you left, turned an offer down or sold on your own.
What is in it
Would your penalty survive in front of a judge?
A penalty close to the whole fee, in a form you did not negotiate, is presumed unfair and void if you signed as an individual selling your own home, not as a business — second signature or not. The ones the courts have already struck out, and an example in figures: a 90% penalty, and what a judge does with it.
Was your advert at the price you signed, not a euro less?
From the day you sign a lower price, that is the price they may advertise. An advert below it is their breach, not yours, and it lets you out of the mandate.
They ask you for €8,100. What do you answer, in black and white?
In Italian, with the articles cited, ready to send by registered post or certified email — and what it says, in your language. With the paragraph to add if the person who handled your mandate was not a registered agent.
If a court order arrives, how many days do you have?
Forty days to oppose it, in the court of the town where you live. And the few cases in which you do owe something, said plainly.
What €59 is, next to your other numbers
We would rather show you the arithmetic than tell you it is good value.
- 0.02%of the price you are about to pay (€250,000)
- 11.8%of the cheapest surveyor’s check, on its own (€500)
- 0.47%of losing your deposit, at the smallest figure it can be (€12,500)
Worked out on a €250,000 purchase, because you have not run your own figures yet. Every comparison uses the number that flatters us least: the cheapest surveyor, the smallest deposit you could lose.
How it works
- In your language, with the Italian beside it: the clauses, the messages and the phrases to use with the notary and the surveyor are written in Italian, ready to hand over.
- Every figure carries the source it comes from and the date it was checked, so it can be verified line by line.
- It is built to be put in front of a surveyor or a notary: it tells you what to ask them, and what a good answer sounds like.
